يَٰٓأَيُّهَا ٱلَّذِينَ ءَامَنُواْ شَهَٰدَةُ بَيۡنِكُمۡ إِذَا حَضَرَ أَحَدَكُمُ ٱلۡمَوۡتُ حِينَ ٱلۡوَصِيَّةِ ٱثۡنَانِ ذَوَا عَدۡلٖ مِّنكُمۡ أَوۡ ءَاخَرَانِ مِنۡ غَيۡرِكُمۡ إِنۡ أَنتُمۡ ضَرَبۡتُمۡ فِي ٱلۡأَرۡضِ فَأَصَٰبَتۡكُم مُّصِيبَةُ ٱلۡمَوۡتِۚ تَحۡبِسُونَهُمَا مِنۢ بَعۡدِ ٱلصَّلَوٰةِ فَيُقۡسِمَانِ بِٱللَّهِ إِنِ ٱرۡتَبۡتُمۡ لَا نَشۡتَرِي بِهِۦ ثَمَنٗا وَلَوۡ كَانَ ذَا قُرۡبَىٰ وَلَا نَكۡتُمُ شَهَٰدَةَ ٱللَّهِ إِنَّآ إِذٗا لَّمِنَ ٱلۡأٓثِمِينَ ١٠٦
O you who have believed, testimony [should be taken] among you when death approaches one of you at the time of bequest - [that of] two just men from among you or two others from outside if you are traveling through the land and the disaster of death should strike you. Detain them after the prayer and let them both swear by Allāh if you doubt [their testimony, saying], "We will not exchange it [i.e., our oath] for a price [i.e., worldly gain], even if he should be a near relative, and we will not withhold the testimony of [i.e., ordained by] Allāh. Indeed, we would then be of the sinful."

(O ye who believe! Let there be witnesses between you) in settlement or upon travelling (when death draweth nigh unto one of you, at the time of bequest) of the dead person (two witnesses) should testify, just men from among you) two free men; it is also said: two of your own people, (or two others from another tribe) who adhere to your religion, as it is said that this means: two people from outside your own people. Then, leaving the question in the case of settlement, Allah mentioned the same question in the case of travelling, saying: (in case you are campaigning in the land) if you are out in the land or travelling (and the calamity of death befall you). This verse was revealed about three men who travelled together for trade to Historic Syria. On the way, one of them, Budayl Ibn Abi Mariyah, a client of 'Amr Ibn al-'As, who was a Muslim, died. But before he died, he requested his two companions, 'Adiyy Ibn Bida' and Tamim Ibn Aws al-Dari, who were Christians, to hand over his property to his people. They however betrayed his testament. So Allah said to the custodians of the deceased person: (You shall empanel them both) the two Christians (after the prayer) of 'Asr, (and, if ye doubt) O custodian of the deceased person that they gave back less than the deceased person had with him, (they shall be made to swear by Allah (saying): We will not take a bribe) let them say: we will not exchange our oath for a paltry portion of this world, (even though it were (on behalf of) a near kinsman) even if the deceased person is one of our kinsmen (nor will we hide the testimony of Allah) let them also say: we will not withhold our testimony, if asked, (for then) for if we withhold our testimony (indeed we should be of the sinful) i.e. of the wrong-doers.

5:104
وَإِذَا قِيلَ لَهُمۡ تَعَالَوۡاْ إِلَىٰ مَآ أَنزَلَ ٱللَّهُ وَإِلَى ٱلرَّسُولِ قَالُواْ حَسۡبُنَا مَا وَجَدۡنَا عَلَيۡهِ ءَابَآءَنَآۚ أَوَلَوۡ كَانَ ءَابَآؤُهُمۡ لَا يَعۡلَمُونَ شَيۡـٔٗا وَلَا يَهۡتَدُونَ ١٠٤
Когда им говорят: «Придите к тому, что ниспослал Аллах, и к Посланнику», - они отвечают: «Нам достаточно того, на чем мы застали наших отцов». Неужели они поступят так, даже если их отцы ничего не знали и не следовали прямым путем?
5:105
يَٰٓأَيُّهَا ٱلَّذِينَ ءَامَنُواْ عَلَيۡكُمۡ أَنفُسَكُمۡۖ لَا يَضُرُّكُم مَّن ضَلَّ إِذَا ٱهۡتَدَيۡتُمۡۚ إِلَى ٱللَّهِ مَرۡجِعُكُمۡ جَمِيعٗا فَيُنَبِّئُكُم بِمَا كُنتُمۡ تَعۡمَلُونَ ١٠٥
О те, которые уверовали! Позаботьтесь о себе. Если вы последовали прямым путем, то вам не причинит вреда тот, кто впал в заблуждение. Всем вам предстоит вернуться к Аллаху, и тогда Он поведает вам о том, что вы совершали.
5:106
يَٰٓأَيُّهَا ٱلَّذِينَ ءَامَنُواْ شَهَٰدَةُ بَيۡنِكُمۡ إِذَا حَضَرَ أَحَدَكُمُ ٱلۡمَوۡتُ حِينَ ٱلۡوَصِيَّةِ ٱثۡنَانِ ذَوَا عَدۡلٖ مِّنكُمۡ أَوۡ ءَاخَرَانِ مِنۡ غَيۡرِكُمۡ إِنۡ أَنتُمۡ ضَرَبۡتُمۡ فِي ٱلۡأَرۡضِ فَأَصَٰبَتۡكُم مُّصِيبَةُ ٱلۡمَوۡتِۚ تَحۡبِسُونَهُمَا مِنۢ بَعۡدِ ٱلصَّلَوٰةِ فَيُقۡسِمَانِ بِٱللَّهِ إِنِ ٱرۡتَبۡتُمۡ لَا نَشۡتَرِي بِهِۦ ثَمَنٗا وَلَوۡ كَانَ ذَا قُرۡبَىٰ وَلَا نَكۡتُمُ شَهَٰدَةَ ٱللَّهِ إِنَّآ إِذٗا لَّمِنَ ٱلۡأٓثِمِينَ ١٠٦
О те, которые уверовали! Если к кому-нибудь из вас явится смерть, и он оставит завещание, то его свидетельствуют двое справедливых мужей из вас или двое других не из вас, если смерть постигнет вас, когда вы странствуете по земле. Задержите их обоих после намаза, и если вы усомнитесь, то они должны поклясться Аллахом: «Мы не покупаем за них мирскую выгоду, даже если он является нашим близким родственником, и не скрываем свидетельства Аллаха. В противном же случае мы принадлежим к числу грешников».
5:107
فَإِنۡ عُثِرَ عَلَىٰٓ أَنَّهُمَا ٱسۡتَحَقَّآ إِثۡمٗا فَـَٔاخَرَانِ يَقُومَانِ مَقَامَهُمَا مِنَ ٱلَّذِينَ ٱسۡتَحَقَّ عَلَيۡهِمُ ٱلۡأَوۡلَيَٰنِ فَيُقۡسِمَانِ بِٱللَّهِ لَشَهَٰدَتُنَآ أَحَقُّ مِن شَهَٰدَتِهِمَا وَمَا ٱعۡتَدَيۡنَآ إِنَّآ إِذٗا لَّمِنَ ٱلظَّٰلِمِينَ ١٠٧
Если будет обнаружено, что они оба повинны в грехе, то пусть двое других самых близких родственников из числа тех, кто имеет законные права, займут их место и поклянутся Аллахом: «Наше свидетельство вернее их свидетельства, и мы не преступаем границы дозволенного. В противном же случае мы принадлежим к числу беззаконников».
5:108
ذَٰلِكَ أَدۡنَىٰٓ أَن يَأۡتُواْ بِٱلشَّهَٰدَةِ عَلَىٰ وَجۡهِهَآ أَوۡ يَخَافُوٓاْ أَن تُرَدَّ أَيۡمَٰنُۢ بَعۡدَ أَيۡمَٰنِهِمۡۗ وَٱتَّقُواْ ٱللَّهَ وَٱسۡمَعُواْۗ وَٱللَّهُ لَا يَهۡدِي ٱلۡقَوۡمَ ٱلۡفَٰسِقِينَ ١٠٨
Поступить так лучше для того, чтобы они принесли истинное свидетельство или устрашились того, что другие клятвы будут принесены после их клятв. Бойтесь Аллаха и слушайте! Ведь Аллах не ведет прямым путем людей нечестивых.
